Baton Rouge, LA asked in Family Law and Child Custody for Louisiana

Q: Father took daughter and won't disclose location and refusing her medical care

Father of my 7 year old daughter took her from his sister's house on May 2nd and we haven't seen or heard from her since. He refuses to let me talk to her, see her or know where they are and won't bring her home. She has a cast that was scheduled to be removed and checked out this past Wednesday and he won't allow her to go and has claimed to have removed the cast himself. We are in East Baton Rouge Parish and we don't have a custody agreement. We've never been married. I was told that him not letting her go to the doctor and removing her cast is grounds for an emergency temporary custody order. Is this true? If not, what are my options to get my child back and ensure she receives proper medical care? Is this considered medical neglect?

A: Removing a cast is easy so I would say no, that is not grounds for emergency custody. However, you do need to hire a custody lawyer to file and get custody.
