Q: Two soon to be parents get into a domestic violence dispute and the police is called the police tells us both the judge

the judge would say we would have to stay away from each other but with us being soon to be parents ether of us want that.

A: This sounds more like a criminal law question than a family law question. It sounds like at least one of you was arrested and charged with an offense such as domestic battery where the judge ordered as a special condition of bond that whichever one of you that was charged has to stay away from the other.

If that's the case, that person who is charged needs a criminal defense lawyer. At least one of you is looking at a jail sentence of anywhere up to 364 days in the county jail in Illinois unless the prosecutors have a good hook to make it a felony where prison is on the line.

If this is the case, do not hesitate. Hire a good criminal defense lawyer who can evaluate the whole case, not just a request to drop the special condition of bail.

A: If either of you or both of you have been arrested and charged with an offense, you or both of you have to hire a criminal defense attorney right away. The sooner an attorney is hired, the better.
