Sanford, FL asked in Criminal Law and Traffic Tickets for Florida

Q: Should I contest speeding if officer pulled me over while standing in the middle of the road (didn’t check radar first)?

I was issued a speeding ticket in my neighborhood yesterday. The officer was standing in the middle of the road and looked at my vehicle as I was approaching. I slowed down because there was a person in the road, he quickly starts pointing to the side telling me to pull over and tells me I was speeding at 30 mph when the limit was 20 mph. Firstly, I do not believe I was speeding because I had slowed down to take the turn before coming into the line of sight of the officer and I had slowed down because he was standing in the middle of the road. He also approached my vehicle without checking his radar, using his judgement and claimed I was going 10 mph over the speed limit. He cited using a radar in the ticket but he was never in his vehicle before he pulled me over. There were no other cars in range, but I don’t believe I was speeding and I don’t think he checked the radar at all although he cited the radar. Do I have an argument in court besides asking about radar calibration?

A: Of course you have a good argument, in my opinion. But asking about radar calibration would be irrelevant.
