Bronx, NY asked in Traffic Tickets for New York

Q: Hi I got $350 worth school zone tickets rushing to work during the pandemic because I work in a hospital.

I wrote the traffic department explaining the reason for my speed but they didn't throw out the tickets. Can I sue for the unnecessary stress it brought me?

A: You violated the law. Who do you think you can sue? The reason for the speed might be a mitigating factor, but you are still guilty. School zone violations are taken very seriously. You can not sue.

A: You can't sue for the stress. There is no legal theory on which to base such a cause of action. If you believe it won't adversely impact your job, you could politely ask if reimbursement from the hospital is possible. The answer is likely to be no at most workplaces, but these are unusual times and there is a sentiment of sympathy and gratitude (and rightfully so) toward health care and hospital workers in general and the sacrifices they have been making for all of us.
