Asked in Uncategorized for California

Q: Good afternoon. I let someone borrow $5,000. She had told me that she would give me back $6,000 by the end of the month.

She never did and now it has been over a year. She stated that she only has to pay back $5,500 per law. Is this true? Even if I have it in writing that she would pay $7,000?

A: Banks are the only entities that should be loaning money, not you. Sorry you were cheated. This is a matter for Small Claims, you should sue for $10,000, to include all pre-judgment interest, your rate of interest is within legal parameters, you can research it in the Financial Code. You need to get your story straight, first you say she would repay $6000 then $7000, which is it? You are entitled to the agreed upon repayment and what she says is not true.
