Q: Is there a law in Cali that requires the court to set a date by a certin point

My licence was suspended for speeding and it ticket for speeding and driving on a suspended licence got bolth reduced to infractions and my suspension was almost up but the corona virus hit and now I’m in limbo is it possible to have the case dropped for this

A: It is not clear from your facts what stage of the proceeding in Traffic Court you were at. Did you have an arraignment? Did you plead guilty? Was the suspension at the time of the ticket for speeding? Did the court suspend your license for 30 days or more? Did the suspension come from DMV? Perhaps you are in limbo because you have not focused on where you are in the process. Both a suspension by the Court after a guilty plea or a trial, and a suspension by the DMV have a set time period of suspension, so there is a date that it automatically stops. If you surrendered your license, you need to go to the place that took it and ask for it back, take your ticket, it is your case number. On the other hand, if your license was suspended because you violated some term of probation or had an FTA or an FTP, it will not be reinstated until you have appeared before a Judge in Court to enter a plea and request reinstatement. Covid shut down the Court for those hearings, but the Courts are reopening now.
