Q: I am currently writing a motion to dismiss due to violation of speedy trial rights. Are there notable cases I can cite?

I am currently fighting a traffic ticket and the court arraigned me after a trial by written declaration on May eighth and the court has set my trial on August 23rd. I tried to look for important California Supreme Court Decisions but could not find any. Anything helps.

A: You should look to the Orange County Superior Court website for the COVID 19 orders that were issued suspending the California "speedy trial act", before you spend a lot of time on this. The presiding judge issued these orders on authority from Orders from the Cal. Supreme Court. They suspended the right to speedy trial during this time period, and thus you may be wasting your time, but if it works for you, go for it. I did not even know they were holding arraignments on May 8, since the Courts were all closed until May 15. Federal Court also suspended the Federal Speedy Trial act.
