Q: can association limit the time of move-in/out in a building to 9-5?
our tenant moved to one of our unit in a condo building in North Bergen NJ. the move took place on a Friday and got extended to 9pm. The association has the house rules restricting move-in/out to Mon-Sat 9-5pm
our questions are
1. can they restrict the days and hours of move-ins?
2. can they penalize the unit owner if the move took place after 5pm ?
3. they determine a fee of $100. and additional $25 for noise. can they impose this?
A: Depends on the organic documents and by-laws of the association. Without reviewing those documents a reasonable analysis is not available.
