Q: Landlord Intentionally Ignoring Me and refusing to set up payment plan as I have been affected by COVID-19
My business was shut down until we reopened (still slow). Apartment management and I agreed verbally with the management office to set up a payment plan. A week later they said they want rent paid in full. I argued my case about the agreement, they said they will talk to the manager. Next day, there's a letter on my door stating how much I am past due. Confused and stressed out and I call the office. They apologized about the misunderstanding and said the first person was supposed to set up a contract. I said ok let's set up the contract. Then they said no sorry actually we need the rent paid in full. I have told them I applied for rental assistance and am doing everything I can, but the payment plan would be the best way for me. They said they will discuss it. Next day I get an eviction notice. More phone conversations (goes nowhere). Today they ignored my family's calls. I went to the office and see they are intentionally ignoring my calls, smiling and laughing at me! Is this legal?!
A: It sounds like these are discussions and negotiations about paying rent. It is not a question is it legal or illegal. It is a question of whether opposing parties can come to an agreement. It takes two to reach an agreement so if one side will not agree, there is no agreement in the eyes of the law in Virginia.
