Opelika, AL asked in Child Custody for Alabama

Q: Hi I have a 7 year old daughter and we live in Lee County Alabama. I have ordered in my divorce decree

"The plaintiff (me) shall have custody of the parties’ minor child

and the defendant visitation at reasonable times and places as agreed upon by the parties." By this terminology I'm not sure if I have sole physical or legal custody? Also I allowed my daughter to go with her father for the summer on the agreement of I call when I am ready for her to return. She left June 15th, school starts August 12th! and it is time for her to be preparing for school and virtual learning here at home. He has not responded to any texts or calls and I can tell that he saw them by the read receipts. I am not sure where my daughter is as he lives in Arizona but was supposed to stay here (Macon County rather) with her at his grandmother's house for the summer visit but I don't even know if they are still there. What can I do to get my daughter back home? Will police help me retrieve her from their residence? because I know for certain he won't just give her to me

A: You have sole custody. Send him a text and tell him you are going to the police department within thirty minutes if he doesn’t respond. Then if he doesn’t, get to the police department and file for interference with custody. Get moving on this quickly if you want your daughter back!
