Q: Can the non custodial parent move out of state? If so do they have to give some type of notice.
I have joint custody of my daughter and I’m the custodial parent. (Father) Her mother has been in rehab and messed up on drugs. She has just recently popped back up and now want to have her weekends in Arkansas. Before she was living in Texas with her parents.
A: The non-custodial parent can move without notice. However, if you reasonably believe that the reintroduction to her child has to be gradual or that her sobriety needs to be proven and visitation needs to be supervised until her sobriety stands the test of time, then hire a custody lawyer to file for emergency sole custody and to modify custody and visitation with supervised visitation to her.
