Q: My roommate threatened to shoot my dog.

My roommate is afraid of my 11 month old puppy who is mouthy but non-aggressive and my roommate is afraid of him. He threatened to kill the dog and told me he has guns in the house. The landlord is refusing to do anything. Is this considered outrageous in the extreme? I feel very threatened and unsafe.

A: Maybe it would be outrageous; maybe not. Regardless, only a landlord can try to evict a tenant for outrageous acts, NOT a co-tenant. If you cannot work it out with your roommate, then your option is to terminate your tenancy and move. Do note that you need to provide your landlord with proper prior written notice if you intend to terminate a month to month tenancy. If you are terminating a fixed term lease early, then you will likely owe either an early termination penalty (up to 1 1/2 months rent, as specified in a written rental agreement) or be on the hook for continuing rent until the landlord finds a suitable replacement tenant. If both you and your roommate co-signed the same lease, then either one of you terminating the lease legally terminates it for both of you (although the landlord can re-rent to the "remaining" tenant IF he wishes) and the non-terminating roommate may have claims against the terminating tenant for his damages if a fixed term lease is terminated early.
