Dallas, TX asked in Family Law, Child Custody and Child Support for Louisiana

Q: Need some clarification on Louisiana support and custody laws to determine if I need a lawyer at court date.

I have 3 children one of which is now 19 and has lived with me solely for the last 3 years. I have consistently paid child support for last 7 years of 860.00 a month as well as 70 percent of all bills. They are with me 4 nights out of the week. At this time I am still paying child support on my 19 year old even though she lives on her own. At this time my youngest child who is 14 now lives with me permanently and seldom visits the other parent. My question is I was told removing my oldest will only decrease child support very little and there is a chance I won’t get a decrease at all and that since we have joint custody with nobody as domiciled parent I still have to pay support for my youngest? Also, I was told since we have joint custody that the courts will not give me domicile rights for him. Is this true with the custodial situation as well as me having to continue to pay support for him even though he lives we me full time?

A: You mention 19 year old who is now irrelevant to child support. You mention 14 year old 4/7 nights with you. You don't mentuin the 3d child or your gross income or the other parents income. You also don't mention who carries health insurance or tuition. Call a custody lawyer to have your support recalculated. The calculation needs to change at least 25% or the court will not change.
