Q: Can I file eminent domain against PP&L four lines that are running around my home two pole that goes two neighbor's hous
These lines do not feed my home my line comes from directly from the main poles I was told by PP&L it would cost $ 12000 dollars to move Pole
A: Without additional information, a more definitive answer is possible. To help you determine if you have a claim, please check the records at the County Clerk’s Office to see whether at some time a right of way agreement which affects your property was granted to a utility and recorded. If the answer is yes, determine the boundaries of the easement. If the poles are within the boundary lines, there is no obligation for the utility to bear the cost of relocation. If there is were not to be any such easement, the utility is trespassing. You would have legal right to force the utility to relocate. A second source of investigation is to review your title insurance policy and the survey endorsement to see what was disclosed to you when you took title to your home. You may find an avenue of relief may be available to you. It would be advisable that you speak to a local real estate attorney.
A: CORRECTION ALERT. The word 'not' was inadvertently omitted between the words "is possible". Please correct your records.
