Alden, NY asked in Banking for New York

Q: I'm not sure what the paper is called but he was in charge of his mother's accounts while she was alive

After our bank switched over to a different bank the existing account in his mother's name along with her boyfriends name was put under my fiancé online bank accounts. So he shows his account and then the other account.

A: It sounds like you are talking about a power of attorney form. Good luck

A: A power of attorney ceases on death. My guess is the bank does not know his mother passed. What to do depends on issues that cannot be discussed on a public internet message board.

A: You are referring to a power of attorney. It terminates upon the death of the grantor (his mother). He can notify his bank of his death (they may ask for a copy of her death certificate), or, as the agent/attorney-in-fact, he can simply ask the bank to remove him from the account titled under his mother's name. It should not be a problem.

Good luck.
