Q: I need to know if it is legal to sell property that is part of marital assets during a divorce proceeding in Oklahoma
A: In the majority of divorce proceedings there is an automatic temporary order. This prevents selling, disposing, destroying, etc.... any marital assets. Likewise, insurances must remain intact as well. Even with the temporary order in place a judge may give permission for one or the other party to sell an asset for due cause, but that has to be authorized by the court and would not be done without the knowledge of the opposing party. Assuming you are currently going through a divorce then your attorney should be able to resolve this issue for you, if you do not have one, then I would recommend you contacting one sooner rather than later, especially if the opposing party is selling things.

A: I would agree with Charles. I have a case like this right now where the house has been sold and the profit is being held by one of the attorneys in an escrow account to be distributed after mediation.
