Q: With no custody order can the other parent demand where and how a regular visit is to be done.
I’ve raised my son since he was one he’s now 5
6 70% overnights to her 30%. She is now withholding him for over a month physically and allowing him to talk to me 1 day a week on the phone.she ignores any questions I have that regard my son. The beginnings of a custody case is in progress with a mediation date set. She is only offering because her lawyer suggested it. Her lawyer also suggested she give me a time limit and demand that there be a place she drops off and picks up from and I must stay at that place with my son and not leave. She filed a cps order for abuse that has been simply dismissed with no doubt or reason to proceed days before she filed for custody. I’ve asked everyday to speak to my son and have asked numerous times to see him. Shes treating me like I’m a criminal, emotionally hurting and confusing my son making me look like a terrible father to him. Obviously not having his best interest in mind and holding him selfishly for personal reasons.
A: Sounds like you are on the path to a resolution through mediation. There will likely be a specific parenting time plan order put in place that you and she can rely on.
