Q: My landlord has threatened my life. Can I terminate my month-to-month lease immediately under these circumstances?

A: You may wish to immediately consult a local landlord-tenant attorney. In Oregon, it is unlawful to record a telephone call if neither party to the call is aware that it is being recorded, so be very careful what you do with that recording. That said, you may well have grounds to get a FAPA restraining order against your landlord. If issued, it will likely evict the landlord from staying at her own house as long as you are there - and it is very difficult for a landlord to get a tenant evicted during the Covid pandemic, so you might get her kicked out for quite a while. FAPA orders are free and designed to be gotten without really needing an attorney's help, though your chances of getting - and keeping - one are much better with the help of an attorney. Applications are available at your local county courthouse. Be exacting and careful in filling out the petition. List EVERYTHING that applies but do not exaggerate; you are likely going to have to back up everything you list and your credibility is everything in this matter. You can also, of course, file a police report about the incident but I would not expect the police to do much. Do document everything as best you can - notes as to time, date, witnesses, exactly what was said, etc. Good luck.
