Nicholasville, KY asked in Contracts for Kentucky

Q: Our contracted closing date was 3 weeks ago, and we get a commitment for a new date. What can we do as sellers?

We are selling our home in Garrard County, KY. The contracted selling date passed 3 weeks ago, and all we are getting is one new excuse after another from the buyers. The buyers realtor has intentionally withheld information about lenders issues, and our realtor had to contact the lender herself. We have been told "any day now" for about 2 weeks. We have been told that the closing date on the contract is irrelevant, and that we are legally bound by the contact regardless of the date. The major problem is that the excuses and delays are putting our purchase of a new home in Russell Springs in jeopardy. What are our rights as sellers in this situation?

A: You can cancel the contract and keep the deposit for their breach of the contract.
