Q: Attempted mediation. Got an pay or quit notice

This is this latest saga of the abuse from dysfunctional property management (who by the way still have yet to provide me my proof of rent payment). This dysfunction has been on going. I have been patient, compliant and followed everything need to be done on my end to be legally protected in california. I have reached out to the rental board in Mountain View, they make you attempt a mediation. They sent out the letter and then I get this notice on my door (after working office hours mind you...and no they do not live on the property). Yes, I am unfairly struggling with unemployment but I have paid as much as I could, and followed all of legal requirements (sending certified letters proving my circumstance and with payment plan which I followed through). I have attempted to find representation for a long time now. Legal aid is a joke and I am sorry to say that. This requires urgency and aggressiveness. Please advise on steps to take to be the most protected and back to normal.

A: So sorry you are experiencing this. It sounds like it may be time to lawyer up, look for a Tenant's rights attorney. You can assist by researching all local ordinances (city, county and state) that apply to your situation and provide you protection from this eviction. Get copies of them for your attorney along with the info needed for him to look them up as well (number, date of enactment, where found on the web, etc.) The good news is that your lease probably provides for attorney fees and that means they will be paying your attorney, once you win. The bad news is that this is not going to help your stress level one bit, and it may cost you some up front money. You should be looking at Judicial Council fee waiver forms and be prepared to fill them out for your attorney. When you win, you may have a retaliatory eviction case. Take photos throughout the apartment now, and every week to show that you are not trashing the apt., and to show any defects affecting habitability.
