Corona, CA asked in Uncategorized for California

Q: I had solar panels installed 7 years ago. Leased for 20 years. Just found out they crossed wires and set up wrong.

have been over paying SCE for 7 years now because of this. They want to come fix after January 2021 yet i still need to make my lease payments on the 1st of every month for something that doesn't work. Have been trying to work with them but the supervisor i am working with does not return my calls. Do i have a case? can I sue them?

thank you

A: First you need to get the electrical problem fixed. You can hire your own electrician and he will need to provide you a letter stating what he found and how it affected your electrical bill. Then, if under $10,000.00 you can sue the installing company in Small Claims. Particularly since the super is not returning your calls. You might send them a 2 sentence letter, saying "I bought solar panels from you that you installed incorrectly, causing me damage; now you don't return my calls. I am going to an attorney for legal representation and will see you in court." If it is more than $10,000, hire an attorney to pursue it for you. I would bet your agreement awards attorney fees to the winner (prevailing party).
