Q: workers comp- Cant get hold of my adjuster and his supervisor but apparently the case has been closed

My lower back got injured at work on august as a result of my companies negligence, I was sent to concentra did all dr's visits and therapies, hot and cold packs, medication and 8 weeks later I was released on full duty. A month later I had not heard from the adjuster so I called him to check the status of the claim , he did not answer or return the call so I left voice mail, Another month which is today I called them again Berkshire hathaway and I was told the case has been closed I asked for the adjuster so he could explain and could not get hold of him again, I asked to speak to the supervisor who also I could not reach but left a voicemail,Life is unfair to the small guys for sure.I just want to know why the claim was closed, and why they don't want to communicate, also how and when this claim will be settled, mind you I tried hiring a lawyer a month earlier and they said my case is not ripe enough. family am being taken on a ride here, any advice is much appreciated.

A: First, your case is plenty 'ripe', scrap that lawyer and get a real lawyer, who needs to rush you far, FAR AWAY from concentra hacks. Next, adjusters blow off people on the phone. Concentra doctors routinely write that patient fully recovered with zero permanent disability and zero need for any future medical treatment, so there is no settlement because zero is due to you. IF You Cannot write that you need a real doctor and real treatment disability, hire the attorney who can.

A: Call the information and assistance office in Sacramento, or put the case on Calendar by filing a DOR on the issues you have listed in your question.

A: your "case is closed" is simply a ruse. while the insurance may have "closed" it in their office, you simply demand they open it and they must. only a work comp judge can close a case; no adjuster can do that. calling and calling them is obviously fruitless as you have experienced. and getting your medical care at Concentra is a mistake as this facility exists to support the insurance industry not the injured worker. the "attorney" you say you talked with gave you bad advise, actually no advice at all if all he/ she said is that your case is not "ripe". an attorney needs to help the case to ripen by nurturing it and helping it along using his / her experise. call another attorney and get a real consultation. its free and confidential
