Q: I got a DUI in California 21 years ago.
Right after I got a DUI in Monterey County California I left the state and moved to the east coast where I have lived since then. When i got the DUI I had recently gotten out of the Marie Corps and didn't have any money to pay fines. I am a 100 percent Disabled Veteran. I was injured in a helicopter hard landing in Somalia. I don't have a lot of money but I would like to get this taken care of.
A: You have two ways to go, come to CA and handle the case or call some local DUI defense attorneys to help you out. The delay between filing and now prosecuting the case will probably create significant difficulties for the government to get a conviction. However, the DMV is a different situation, hopefully your lawyer can explain what can be done.
A: INITIALLY THANK YOU FOR YOUR SERVICE.
YOU MAY WANT TO TRY TO SEE IF THE LAWYER WHO HELPED YOU INITIALLY IS STILL PRACTICING AND ASK HIM/HER FOR ASSISTANCE.
EITHER YOU HAVE TO APPEAR OR A LAWYER PURSUANT TO 977PC ON YOUR BEHALF.
YOU MAY WANT TO CHECK YOUR CRIMINAL RECORD AND DMV RECORD TO SEE HOW IT READS.
THERE SHOULD BE A BENCH WARRANT OUT FOR YOUR ARREST FOR VIOLATING ONE OF THE TERMS AND CONDITIONS OF YOUR PROBATION.......MAYBE THE LAWYER CAN PUT THE MATTER ON CALENDAR AND ASK THE JUDGE TO REVISIT THE FINE AND WAIVE IT UNDER THE CIRCUMSTANCES.......A PUBLIC DEFENDER MAY BE ABLE TO HELP OR LEGAL AID OR MAYBE A LOCAL LAWYER PRO BONO.......
