Q: Have been wrongfully accused of assult and battery against a friend

the person who called is an alcoholic and was in bed not knowing anything and just assumed the worse mean While the person i was arguing with was off her medication and not her normal self and I had left to De-escalate and came back the next day to collect my belongings to then find out and my friend who was off her meds then verbally attacked me and the person who called the nignt prior. The lady who called said she was sorry for calling and would do anything in order to straighten out her mistake as well and that she had called the cops on the wrong person laughing about it. I dint know what to do never been in trouble wavied my rights to a lawyer what should I do my pre trail is oct 30th shouldnt even be in court from heresay

A: What do you mean you waived your rights to a lawyer? If you have the financial ability, you should hire a defense attorney. If not, you should request the court to appoint a public defender. Even if you didn’t do anything wrong, this is too important to try to handle on your own. You need someone who understands the process, rules of evidence, and has experience defending against assault and battery charges.

A: If you've been found indigent, the court will provide you with an attorney. Massachusetts has some great court appointed lawyers. If you can afford private counsel, you can go that route. It sounds like your case is still in the pretrial stage. It's important that you communicate with your attorney. I wish you well.
