Denver, CO asked in Contracts, Landlord - Tenant and Real Estate Law for Colorado

Q: Can property staff add rules not in the lease? Tenants now have to show ID to enter & exit the open layout apt. complex

1 Lawyer Answer

A: When you sign a lease it is common to have a provision that you will abide by the Association/Complex/Building Rules. These can be modified at any time without changing the terms of your lease. If the rules now provide that ID must be shown, then under the terms of the lease you must abide by the request or you would be in default under your lease and could possibly be evicted. Take a look at your full lease and the Rules which should have been provided to you. If in doubt about the terms, take the documents to a local attorney who can review them and explain your rights and responsibilities under the lease and the laws of your state.
