Q: is it considered best interest of the child to be with their mother instead of daycare?

I have joint custody of my children part of the week. My ex husbands babysitter quit and I would like to watch the kids on Fridays (not a school day for them and i work from home). He is denying me that possibility (he has a narcissistic personality and I feel is a way of controlling and hurting me) and wants to send them to his friend's house instead. Do I have any right to request this time with my children if he is at work? Is there anything I can do about it?

A: Although there is no automatic right to care for a child during another parent's parenting time simply because the other parent has hired a babysitter during their work day, you could request a modification based on the best interests of the child if you can show that your availability is continuing, and it is in the best interests of the child to be under your care. You should consider what your availability to the child during your work day would be.
