Ludlow, MA asked in Animal / Dog Law for Massachusetts

Q: Purchase puppy from breeder in GA I live in MA dog sick 24 hours after $7,800 vet bill to save what could I do

No contract I have all text messages which we did the deal he has a website which he has all his terms and conditions that gives a cash refund if the dog is found to be sick 72 hours by a legal veterinarian he did tell me that his littermate tested positive the night before I was going to pick her up but that she had tested negative so I figured it was okay you said at some point she could pop off with it so after 24 hours at home she ended up in the ICU would cost 1100 a night my grand total is $7,800 plus the $2,500 that I purchased her for

A: First, I am so sorry that your new puppy was sick! As to your course of action, it depends. You are above the amount for small claims court but it can be hard to get an attorney to take a case to trial if the sum isn't a lot higher. You may be able to do a demand letter for a settlement amount. If you do it as a 93A consumer protection action, you may be able to ask for triple damages at trial if the breeder won't settle. You should contact an animal attorney, do a consultation, and get an opinion after she or he reviews some of the documentation and talks to you personally.
