Q: i signed a Ky realtors contract to purchase a property. the title company has discovered none of the sellers that signed
the agreement are actual deed recorded owners. they are relatives of prior deceased family members that willed the property to them in about 1981. there was an executor and another current living owner that did not sign the contract. children that have no legal deed recorded signed the contract. I am now leary, am I even a part of a vaild contract since those signing as sellers have no recorded paper trail of ownership to the property. There are no recorded POA's either.
My question is only if the sales contract is valid since since those signing as sellers legally do not own the property.
A: Unless all proper sellers are party to the contract, the contract is void.
