Q: My son turned 18 in September and no longer wants to live with his dad. Do we have to go to court
My son lives in Louisiana and his dad has had custody for the past year. He is 18 and no longer wants to live with his dad. He has dropped out of highschool. Can my son legally just leave or do we have to go back to court?
A:
Over 18 and not in high school:
1) He can live where ever he likes.
2) No child support due for him unless he enrolls in Hi-Set before he turns 19.
3) If he is in high school or Hi-Set and lives on his own, then child support for him owed to son, not father.
4) If son lives with you, then no child support owed for him.
5) If there are other minor children, disregard 1-4 and hire a child support lawyer immediately.
