Philadelphia, PA asked in Traffic Tickets for New Jersey

Q: I was pulled over for speeding as stated by the officer 19:9-1.2 .39 and also ticketed for 3 other offenses

I was pulled over for speeding in Jersey as stated by the officer 19:9-1.2 .39 but ticketed for 3 other offenses 39:4-96, 19:9-1.3c, 39:4-88A. Two are payable the other two I have to appear in court. What would you recommend I do? Pay the two or just wait until my court date to see what happen also what are the charges?

A: First you should hire a lawyer, as you do face up to 60 days in jail on that reckless driving ticket assuming it is a first offense and up to 90 days in jail if you have done this before. Also you face a probable suspension of your drivers license on the speeding ticket. That is why those tickets have a mandatory court appearance as the judge will have to determine your penalty, as your facing more than just points and a fine on these tickets. If you have a CDL that reckless driving ticket can even lead to the loss of your job.

If you do not want to hire a lawyer, I would not suggest paying the tickets because by paying the ticket you admit that it was you at the scene and thus you give up certain defenses you may have to the other tickets. Most of us traffic ticket lawyers offer a free in office consultation, I would suggest that you set one up since you are facing not just points on your license, but possible suspension and even possible jail time!

A: These are both NJ Turnpike violations and NJ Statutory violations.

39:4-96 is reckless driving- 5 points. 39:4-88b - 2 points. Don't know offhand about 19:9-1.2.39-sounds like speeding.

I strongly advise you to get a lawyer.

I wouldn't pay any of them now. Deal with all at once.

A: 19:9-1.2 .39 - Speed Violations, probably 39 mph over limit

39:4-96 Reckless Driving

19:9-1.3c Failure to maintain L:anes or traffic signals in a 65 mph or Safe Corridor

39:4-88A. Failure to maintain lanes

The 96 and 88A have points

The rest are fines

DO NOT pay for some and then go fight. Please guilty to all and then find Counsel to work out a deal with the Prosecutor.
