Q: Court date/ 72 hr hold

My husband was scheduled to go to court today but was not called and was not seen.. If charges are not filed after the 72 hour period will he be released?

Lastly, When I pull up his information is states his charges, bail amount for current charges and under disposition is has "CONT" not clear on what that means.

I ASSUME HE IS IN CUSTODY. I ALSO ASSUME THE COURT APPOINTED OR WILL APPOINT A LAWYER FOR HIM WHO CAN ANSWER THAT QUESTION BETTER THAN SOMEONE ON A SITE LIKE THIS.

CONT MEANS CONTINUED. NOT SURE IF THERE WAS A VIDEO ARRAIGNMENT OR NOT.

HOWEVER, IF NECESSARY THE DA WILL DISMISS AND REFILE.

MAYBE CONTACT THE PUBLIC DEFENDERS OFFICE.

A: If no charges were filed and there are no other "holds" from other cases he may have, he should be released. However they have up to 1 year to file a misdemeanor and 3 years to file most felonies. If they don't have the evidence together yet (lab results, videos etc) they will release him and then send an appearance letter if and when they file it.

If he is on Probation or Parole, these same rules may not apply.

What was the arrest charge?

Hopefully he is home already, but as i said, the Government may still file charges so he may want to consult an experienced criminal defense attorney who can follow up with the DA.
