Boise, ID asked in Uncategorized for Idaho

Q: Im medically exempt from wearing a mask. Manager at gas station state ineed to still wear a mask/pull shirt over my face

Knowing that I am medically exempt. When I told her this is discrimination she fired back with how do I know you have a medical issue. Have any proof. Would I have a solid case for a ada discrimination lawsuit and a mental anguish claim?

A: An Idaho attorney could answer best, but your question remains open for two weeks. Although this site does not have a separate heading for the Americans with Disabilities Act, there are attorneys with expertise in that area. An attorney who regularly works with ADA matters might be able to offer the most meaningful insight here. For the mental anguish elements, you could reach out to attorneys who such handle cases to ask if they offer free initial consults. Good luck

A: If you are "medically exempt" from wearing a mask, why don't you carry a note from your doctor that says:

"My patient is healthy and believes it violates their 1st Amendment rights to "associate" with others. If you choose to do business with them, you are taking a risk that they carry the Covid-19" virus but are as yet, asymptomatic, but you are taking your own risk."

Signed,

Physician

"Your freedom" to throw your fist, ends with the tip of my nose."

Go ahead and refuse to wear a mask, until as in this case, someone says, "your freedom not to wear a mask is colliding with my right to live." My right to live is paramount to your right to refuse to wear a mask.
