Palm Bay, FL asked in Employment Law, Civil Rights and Employment Discrimination for Florida

Q: I was recently terminated and I am sure it was due to discrimination but was covered up by a probationary termination..

A: You did not ask a question, but I assume your question is, "Can I make a claim?". Probationary termination cases are tough, since the employer needs no reason whatsoever to terminate, but at the same time, the your race, sex, age, national origin, etc. cannot legally be the reason for termination. To be "sure" that's the reason, there must be very strong proof, not just speculation. The proof may be either direct evidence ("I don't like blacks", for example) or circumstantial evidence (for example, no logical reason whatsoever on their side to terminate and then replacing you with someone who is not your race, sex, age, etc.). You'll need to consult an employment law attorney and go over all the facts in order to determine if you have a worthwhile potential claim.
