Q: I currently live in PA but I am making a move to Nebraska for schooling. Im so confused on how to get benefits in here.

I'm making a move to Nebraska from PA for college. I get medical assistance for my son and thats it. My sons father is not involved at all and I don't get child support either I never did. Now I had someone tell me the only way I can get daycare and medical assistance is if I am getting child support from my sons father. Is this true?

A: Every parent has a legal duty to support their child; it cannot be eliminated simply by not being part of child’s life. As far as I am aware, every state requires a person seeking public benefits and assistance to also attempt to obtain child support from other parent. In this case state funded daycare and medical care trigger the requirement to seek child support from the non-custodial parent.

The good news is the legal services required to do so are provided to you at no cost through the state agency assigned responsibility. Whether you are actually required to have a child support order before receiving assistance is a matter of state law.

If the child starts receiving public assistance, such as Medicaid or day care assistance, it will trigger the child support office to begin a court action to ask for the father to pay child support for the child.
