Mission Viejo, CA asked in Criminal Law and Federal Crimes for California

Q: I need advice on what to do for my court date on January 4th, 2021. I have been charged with fraud and identity theft.

I'll try to make this as short as possible. My little sister called the cops on my mom for opening a credit card under her name when she turned 18 in 2014. I helped my mom open the card. My sister knew about the card prior but also was on meds that cause mem loss. My sister called the cops on my mom because she was upset with her for something else, so basically a threat. She assumed it was a warning and had no idea my mom and I would be arrested. Now my sister is trying to drop the charges, but with a charge that serious, I am unsure what the outcome will be. The Amazon credit card was open under my email/ phone number. The credit only was at $3,800 and was mostly just interest since it has been closed for a few years. Everything is paid off now. I lose my license to teach. I have no money to pay for a lawyer and feel hopeless.

A: If your sister who is the complaining witness is dead, the prosecutor has no witness anymore. Don't worry and talk to your public defender next year.

Good luck!

A: more info needed.

in my opinion, this is not the best place to discuss your matter. It is not private and ANYONE can read what is said.

you either retain a lawyer or the court will appoint one. The more important facts are the evidence the DA has and what that could prove.

wait until a court-appointed lawyer reviews all the facts and then ask him/her the questions you have.
