Q: What age can my partners children choose to live with us and be acknowledged in court?

My partner just went to court for his two children 8 &10 to come live with us, the mother took them to Arkansas when they were little, we live in LA We only got Awarded for them to come once a month to our house for less than 24 hours She lied the entire time during mediation. The mother always refuses to let us see them. The children cry every single time when they are with us that they want to live with us and that she doesn’t do right by them. She’s always having different men over every night and they see her doing this and makes them stay in their room. They tell us she doesn’t wash their clothes and they have to pick out dirty underwear from the laundry to rewear. When they tell us stuff like this and she finds out she doesn’t let us speak to them on the phone for weeks at a time and punishes them for telling us. It’s just a horrible situation They beg & beg and cry & cry for us to have them but when we went to court nothing was done. At what age can they choose to live with us?

A: At age 12 the children can have a direct voice in where they live. However they can have an indirect voice now with a custody evaluation. Hire a custody lawyer and file an Objection to the Hearing Officer's Recommendation.
