A: I am sorry for your loss. If the land was titled in his name only, you will have to go through probate. If it was titled in his and your name as joint tenants, you can file an affidavit of termination of joint tenancy (or go through probate if there are other reasons to have his estate probated). If the title was in his name and yours as tenants in common, you will have to go through probate to sell his interest. The sales procedure in probate will depend upon whether he died with or without a will and if he has a will and the terms of the will. You should contact a probate attorney who can review the title and help you through the process.
