Santa Ana, CA asked in Uncategorized for California

Q: A refrigerator company won’t replace or service my fridge after they have already serviced it 3 times.

I haven’t had a fridge for about the past 4 months. After they have sent out 3 technicians, I didn’t want to go through that process again. It was deemed unrepairable. Which is what they said they needed to get a replacement. Neither the people I bought it from want to do anything about it and I keep going in circles with them and nobody want to do anything, while I have no fridge in my home.

A: This question should be in the category Consumer Law in order to get the right attorneys to view it. As a consumer you are entitled to whatever specific warranties the seller offered you and if you started having problems and reported them within the warranty period, you will probably be successful in Small Claims Court seeking a full refund of your money, plus, if they failed to sell you a fridge that worked, in the first place, you could make them responsible to pay for you to obtain a replacement refrigerator that was substantially the same, even if the new fridge is more $$. A lot depends on your warranty, read it carefully. Do not delay as acting quickly is important to you. When you go to court you should have all the repair invoices, along with your original purchase invoice. If you were to rent a fridge in the interim, you might be able to recover the rental value as well, particularly if they delayed in repairing/replacing the defective unit.
