A: Not necessarily. There is a crime called interference with custody. But, it is highly fact dependent. For example, if your wife takes your kids out for ice cream while you are at work and doesn't tell you, you don't know where they are but she doesn't have to tell you every little thing. If you happened to live near the border, and the ice cream shop was across the line, that would make no difference. On the other hand, if your wife puts the kids in the van and drives to Florida fully intending to take the kids away from you, she may be guilty or she may not. A woman fleeing abuse with her children is not guilty. I woman simply stealing the kids away from their father is. So a lot of information is needed to answer your question.
