Q: As a victim of an accident is one entitled to "be made whole" by the insurance company of the defendant?
The defendant's insurance company has agreed to repair my vehicle, however, are not willing to provide a free rental vehicle equivalent to that being repaired.
A: The law in most states only requires that they give you A rental vehicle. You lost a Lamorghini--they can get you a toyota corolla. The only time I've gotten exceptions are where the vehicle was particular to that person's business or health-- a vehicle that could accomodate a wheelchair, a truck to haul the boat of a professional bass fisherman, etc.
That being said, if you are an AAA member ask them who in their hierarchy knows this; best bet is contact your insurance commissioner's office. If it's your policy, may be different.
