Q: Do I still have to pay state ordered child support if one of my kids now lives with me?
I was originally ordered to pay child support for our 3 kids. Now my kids are 16, 17, and 20. My 17 year old now lives with me. My 16 & 20 year old are still living with my ex wife and my 16 year old has become very disobedient and is performing horribly in school. Since only my 16 & 17 year olds are eligible to receive child support & one of them lives with me, shouldn't that be grounds for terminating the child support order? Or at least changing the amount?
A: Yes, it is cause to modify support but not terminate support. Hire a custody lawyer immediately.
