Q: Is it a legal requirement to provide kids with a bedroom if you only have them every other weekend.
I realize you should, but is it legally required? Could it prevent/remove parenting time?
A:
Like many things in family law, it depends. It depends on where the kids sleep now. It depends on their ages. It depends on their gender. It depends on what else is going on in the house, and with you. It mostly depends on if the other parent makes it in issue.
Unless CPS or the police get involved for some reason, the court is going to let you two be. If you ask for more parenting time, or the other parent asks that you have less time, then the court needs to get involved, and this bedroom issue is fair game. Obviously a lot of factors play into a parenting time decision, and so I don't know if a lack of bedroom would cause the court to suspend your overnights; I certainly can see it being a tough argument to make for more parenting time for you.
