Q: So im wondering i am going through divorce and there was an accidental condo fire... Am i now in contempt of court?
Standard mutual protection order: Pursuant to Local Domestic Rule 43, IT IS ORDERED that effective on the date a Complaint is filed, each spouse is enjoined from committing any of the following acts:
"Selling, damaging, destroying, removing from its present location, encumbering, disposing of, lessening the value of, or in any manner secreting the assets of either spouse, including, but not limited to real and/or personal property, household furniture, furnishings, contents, appliances, automobiles or other vehicles (except as to the use of one)
And: "Causing the utilities at the marital residence to be terminated;"
Also my wife is refusing to disclose her location.. She claims she thought she got the same protections from this as the bs ex parte dv cpo she decided to dismiss 2 days before the trial that was stayed 4mo for hearing "or concealing the whereabouts of the minor child/ren of the parties during the pendency of this action." How to compel with the quickness?
A: Accidental fire is not a violation. If she is keeping the children from you, you need to file a motion for parenting time.
