Q: Okay so I live in Louisiana being sued by a client in Alabama.

The puppy was vet checked and had a clear bill of health before leaving my home. My contract states they have 72 hours max to get the puppy in with a vet for a wellness checkup and send me proof that this had been done. If this isn't done my health guarantee is voided. The client didn't do this.. Now going back a little,she contacted me when the puppy was 4 months old saying she had a ear problem but refused to send me vet records . now nearly 2 years later she is suing me for the vet costs which my contract clearly states I'm not responsible for if the puppy isn't in my care. My question is would I stand a chance in court??

A: Yes, you should fight this---at a minimum, you need to consult with an attorney as this matter may be pending in Alabama or Louisiana and if you have a written agreement, then does your agreement state where you can be sued and/or under which choice of law applies? Also, and I am going on memory so it would need to be verified, but it is possible that under Louisiana law, the deadline (prescriptive date) to file suit against you on a sale of a dog may have long passed and this may also be a legitimate and valid defense for you.
