Q: I was charged 2nd degree burglary my first offense is it possible to get probation im taking care of my sick mother

I went to my girlfriend to wait on her she always let me come in and wait cause it was a little cold but i was under the influence got the stupid idea of driving her car down the street for us something to eat on way back i was in an accident i wasnt trying to burglary only crime i knew i was committing was dui but i wrecked her car she got mad i did 3 weeks in jail when i got out we got back together shes even trying to drop charges im taking care of my 73 year old mother with health conditions and a 16 year old it is my first felony can i get probation i honestly dont see how i was charged with burglary because she always allowed me to come in and wait for her she didnt give me permission to drive her car that day but i didn't think i was committing burglary since she my girlfriend and i was told i was always allowed to come in i didn't think i had to ask her every day me wreaking her car is why she had me charged now she cant take back what she said to the officer

A: Yes. Burglary second degree is eligible for probation in Kentucky. I would hire a skilled defense attorney to present your best argument to the court and the prosecutor and if you have a clean record you have a much better chance of getting probation or perhaps even diversion if the charges are lowered.
