Ft Mitchell, KY asked in Criminal Law for Kentucky

Q: A mechanic messed up my brakes while "inspecting them" and I nearly got in a wreck. Can I press criminal charges?

brakes were functional before service. The mechanic told me explicitly I did not need brake work. The brakes failed, I noticed a brake fluid leak, second party mechanic confirmed and documented that the brakes had been reassembled incorrectly causing the leak.

A: This sounds more like a civil case where you could file an action against the mechanic, his garage or their insurance company if you can prove it was his fault. I don’t think there would be criminal charges unless you can prove this person directly tried to hurt you rather than just doing bad work on your brakes.

A: No. It’s a negligence claim in a civil action.
