Minneapolis, MN asked in Criminal Law and Domestic Violence for Minnesota

Q: If I'm the victim of a domestic but want to recant my statement how can I do that?

I feel I was miss understood by the police and because I was miss understood my ex is being charged with something he didn't do.

A: You can't certainly contact either law enforcement or the prosecutor to address this issue. In all likelihood, your initial statement to law enforcement was audio recorded, and perhaps video taped as well via a body cam. So there should be an accurate recording of your statement. You certainly have a right to change that statement or to provide additional information, but that is no guarantee that the charges will be dismissed or be changed. You client would be better served by having a good attorney representing him.

A: You could give a second statement to the police or the prosecutor. But it would be better for the defense to give a second statement to an investigator working for the defense attorney.
