Q: When my lease is ending, I have the right to go month to month? My property said the shorteast is 4 months. Is it legal?

A: Leases can be for any length of time which has been agreed t0 between the parties. There is a limitation to the length of a lease. A lease for more than 99 years is considered to be a conveyance, i.e. a transfer of title. Leases to be enforceable must be in writing. However, an oral lease of less than one year will be enforceable. Further, in NJ, all leases, irrespective of being oral or written, are deemed to have included the provision of quiet enjoyment. All contracts ii NJ are deemed to have included a provision of fair dealing and good faith.
