Q: For statute no 39 4-97.3, if you are at a stop sign and you look at your phone. Are you violating the statue?

A: Yes, you are as the statute say using, and also says that it shall not impede operation. If you are at a Stop sign, you are not paying attention to the road and the flow of traffic

A: Yes nearly all judges would consider this a violation of the statute, in any event since this is only a fine for a first offense it is generally just smart to pay it anyway as to get a real defense a good lawyer would charge you many times the cost of the ticket.
