Q: can i be charged with dus if i wasnt driving and the cop came in store/the call was some1 gettrn high in parkinglot
Like it was my b/f car my buddy was driving we was in dollar general someone called said someone was getting high in parking lot. officer came in store we was only ppl there and asked me to step out to talk to him. mind you i was pretty messed up why i wasnt driving they asked whos car/owner etc. and I told them my buddy was driving they went and got him asked him and he said he was driving he had keys and all but some how I ended up getting a ticket for dus and I wasnt driving the cop was there for another reason how can this be?
A: When you say dus, are you referring to driving under a suspension? For any charge, the state has the burden of proof. If they lack the evidence to prove that you were driving it sounds like you need to fight the charge. Doing this by yourself can be very difficult.
